We believe that the best time to address a problem loan is before it goes into default. This gives the borrower a better opportunity to demonstrate that it can "work out" the problem in conjunction with the bank. Given the high volume of foreclosures and challenges within the banking industry, getting banks to address problem loans before going into default is often a challenge but well worth the effort. However, this is serious business and all borrowers are well advised to seek competent legal and financial advice in order to make the best informed decisions.

• Forbearance ... the temporary reduction or suspension of monthly loan payments
• Loan Modification ... a one time modification of loan agreement terms which may include a reduced interest rate, extended length of the loan, principle balance reduction, etc.
• Pre-foreclosure or Short Sale ... sale of the asset by the borrower below the value of the note
• Deed in Lieu of foreclosure ... transfer of the property deed to the bank in exchange for cancellation of the loan
• and as a last resort ... Legal Foreclosure

 

WHAT ARE THE MAIN STEPS IN A COMMERCIAL OR RESIDENTIAL "Non Court Ordered" or "Pre Suit" REAL ESTATE FORECLOSURE MEDIATION?

1) Both parties agree to pursue mediation to resolve the dispute

2) Initial Contacts Between the Mediator and the Parties

• The Mediator coordinates the first meeting
• The process is clearly laid out to both parties
• The borrower agrees to submit a "Quick Qualification" financial summary to determine the best approach to pursue to achieve resolution

3) First and Subsequent Meetings (if necessary)

• Agreeing to the ground rules of the process
• Identifying the key issues to resolve
• Identifying the interests of both parties
• Developing options for settlement and agreement
• Evaluating options and reaching agreement

4) Conclusion

• The settlement is recorded in an enforceable contract

Our goal is to assist our clients in successfully resolving the difficult financial issues associated with loan and mortgage default leading to potential foreclosure. Good, hard working people and long established businesses alike can easily find themselves in a very difficult position of not having sufficient income to meet their ongoing financial obligations in this current difficult economy.

Lenders and borrowers must find the most cost effective and timely approach to resolve these  loan problems. 

It is a great loss for both parties if the loan problem gets to the point of Legal Foreclosure without having exercised all possibilities to find a way to save the loan in a way that works for both parties.
